Welcome to Brivfy! These Terms of Service ("Terms") govern your access to and use of the Brivfy website (www.brivfy.com) and the Brivfy mobile applications for iOS and Android (collectively, the "Services"), owned and operated by Digital Living Co., Ltd., a company registered in Thailand ("Brivfy," "we," "us," or "our").
Please read these Terms carefully. By downloading, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
1. About the Services
Brivfy delivers concise daily news briefings across categories such as world news, politics, business, technology, entertainment, sports, and climate. Our editorial team writes short, original summaries based on reporting from third-party publishers and credits the underlying sources. For details on how our content is created, see our Editorial Policy.
Brivfy provides content for general informational purposes only. Briefings are not professional, financial, legal, medical, or investment advice, and you should not rely on them as such.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of legal majority in your jurisdiction, you may use the Services only with the consent of a parent or legal guardian. By using the Services, you represent that you meet these requirements.
3. Your Account
Some features may require an account. You agree to provide accurate information when registering, keep your credentials confidential, and notify us promptly at contact@brivfy.com if you suspect unauthorized use of your account. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.
4. License to Use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use. This license does not permit you to:
- Copy, reproduce, republish, scrape, or redistribute Brivfy content at scale or for commercial purposes without our prior written permission
- Use automated tools (bots, crawlers, scrapers) to access the Services, except as permitted by standard search engine practices
- Reverse engineer, decompile, or attempt to extract the source code of our apps
- Remove or alter any copyright, trademark, or attribution notices
- Use the Brivfy name, logo, or brand assets without our written consent
5. Acceptable Use
You agree to use the Services only for lawful purposes. You must not:
- Violate any applicable law or the rights of any third party
- Upload or transmit viruses, malware, or any code designed to disrupt or damage systems
- Attempt to gain unauthorized access to the Services, other users' accounts, or connected systems
- Interfere with or disrupt the operation of the Services or the servers and networks that support them
- Harvest or collect information about other users without their consent
- Send spam, chain messages, or unsolicited promotional material through the Services
- Post or share content that is unlawful, defamatory, obscene, threatening, harassing, hateful, or that promotes violence or harm
We may remove content, restrict features, or suspend or terminate access for violations of this section, with or without notice.
6. User Content
Where the Services allow you to post comments, feedback, or other content ("User Content"), you retain ownership of your User Content. By submitting it, you grant Brivfy a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content as reasonably necessary to operate, improve, and promote the Services.
You are solely responsible for your User Content and represent that you have the rights necessary to post it and that it does not infringe the rights of others or violate any law. We do not pre-screen User Content, but we reserve the right to review, remove, or disable access to any User Content at our discretion.
7. Third-Party Content and Sources
Brivfy briefings are based on reporting by third-party publishers, and the Services contain links to external websites, articles, and services that we do not own or control ("Third-Party Content"). We provide source links for attribution and convenience only. We do not endorse and are not responsible for the accuracy, availability, or practices of Third-Party Content. Your use of third-party websites is at your own risk and subject to their own terms and privacy policies.
8. Intellectual Property
The Services — including Brivfy's original briefing text, headlines, design, graphics, logos, software, and overall look and feel — are owned by Digital Living Co., Ltd. or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
Underlying news reporting referenced in our briefings remains the property of the respective publishers, whom we credit as sources.
9. Copyright Complaints
We respect intellectual property rights. If you believe content on the Services infringes your copyright, please send a notice to corrections@brivfy.com including: (a) identification of the copyrighted work; (b) the location of the allegedly infringing material; (c) your contact details; (d) a statement of good-faith belief that the use is unauthorized; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the rights holder. We will review and, where appropriate, remove or disable access to infringing material and may terminate repeat infringers.
10. Push Notifications and Communications
With your consent, we may send push notifications for breaking news and daily briefings. You can disable notifications at any time in the app or device settings. By creating an account, you agree to receive service-related communications; marketing emails always include an unsubscribe option.
11. Changes to the Services
Brivfy is continuously evolving. We may add, modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.
12. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.
13. Disclaimers
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. While we strive for accuracy in our briefings, we do not warrant that content will always be complete, current, or error-free.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Digital Living Co., Ltd., its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Services, any Third-Party Content, or any conduct of third parties on the Services. To the extent permitted by law, our total aggregate liability for any claim arising out of these Terms or the Services shall not exceed the greater of the amount you paid us (if any) in the twelve months preceding the claim or THB 3,500.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights in your country of residence.
15. Indemnification
You agree to indemnify and hold harmless Digital Living Co., Ltd. and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, or your violation of these Terms or applicable law.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law principles. Before initiating any formal proceeding, you agree to first contact us at contact@brivfy.com so we can attempt to resolve the dispute informally in good faith within 30 days.
If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of Thailand, unless mandatory law in your country of residence provides otherwise. Where you are a consumer, these Terms do not deprive you of protections granted by the mandatory laws of your country.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Services (such as an in-app notice or website banner) or by email, and update the "Last Updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Prior versions are available on request.
18. General
These Terms, together with our Privacy Policy and Editorial Policy, constitute the entire agreement between you and Brivfy regarding the Services. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
19. App Store Terms
If you download the Brivfy app from the Apple App Store or Google Play, your use is also subject to the applicable store's terms of service. Apple and Google are not parties to these Terms and have no responsibility for the Services.
